Being as I am a member of the BNFM, can I go out to hunt objects legally? I found out that I must register my machine with the Ministry of Culture {MOC) in order to go out detecting. Being as I have to register my machine, will I receive some kind of documentation from MOC certifying my registration? What if I am out searching with my detector and I am approached by the police? What would I be able to present to the police to show that I am searching only as a hobby?


Are the laws written in BLACK AND WHITE or are there still too many GRAY areas??


I have tried to "Google Translate" as much of the forum as I can but I have not found any clear translation of the Laws. I hope by asking these questions there will be an open discussion concerning the laws. Let's see what happens.

In Bulgaria, you can search outside the registered monuments. Yes, you must file an application for registration of your metal detector to the Ministry of Culture. But you will not get back any document from them. This is because, according to an ordinance we need to register their metal detectors, but according to other regulations we can not and do not have metal detectors to register. Paragraph 22.
The lawyers of the Federation of Metal detecting advise all members to submit applications for registration of their metal detectors.

I have a suggestion.
Could the lawyer for the BNMF create a document that could be sent into the Ministry of Culture (MOC) along with the application requesting a signature from an "Official" of MOC certifying that detector has been registered? It could be short and to the point. Something to the effect:
CERTIFICATE OF REGISTRATION OF METAL DETECTOR
____(name and ID# address)___________, has registered, ____(machine and serial #)_______, with the MOC for the hobby of metal detecting and is hereby authorized to search public areas not restricted by law and private land with the permission of the land owner. This individual, (according to mandate,law), must turn in all objects of Cultural Value to local officials within a 7 day period.

Add a space for a signature and official stamp from MOC

This form could be more inclusive or more simple.

The form could be available to down load from this site by members and others or limited it to just members of BNMF, whichever would be appropriate, and sent in with the application along with a self addressed stamped (with postage stamp) envelope for return delivery to the person registering the machine so there is no cost to MOC for return postage.

Правата по регистрацията не се прехвърлят и преотстъпват.
Специалното техническо средство се използва само при извършване на теренни археологически проучвания за периода на издаденото разрешение и за територията на извършване на проучването.
При промяна на обстоятелствата, при които е извършена тази регистрация, регистрираният е длъжен в 7-дневен срок от възникване на обстоятелството да уведоми писмено министъра на културата.
